FT Game License and Service Agreement

The "FT Game License and Service Agreement" is entered into by you and FT, and this agreement is legally binding. Please carefully read and fully understand the terms, especially the clauses that exempt or limit FT's liability, restrict user rights, specify dispute resolution methods and jurisdiction, and any separate agreements for accessing or using specific services. The aforementioned limitations, disclaimers, dispute resolution methods, and jurisdiction clauses may be highlighted in bold or other reasonable ways to draw your attention.

Unless you have read and accepted all the terms of this agreement, you are not authorized to use FT game software or receive FT game services. By clicking "Confirm," "Agree" buttons, or using FT game software and accepting FT game services, you are deemed to have read and agreed to sign this agreement.

If you are under 18 years old, please read this agreement with the accompaniment of your legal guardian and pay special attention to the terms for minors' use.

1. Parties to the Agreement

This agreement is signed between the following parties:

1.1 FT: Refers to Hangzhou FT Technology Co., Ltd. or its affiliated companies or cooperative enterprises, which provide FT game software or services to you.

1.2 You: Refers to the natural person who obtains non-commercial authorization from FT through legal channels, thereby installing, using FT game software, or receiving FT game services.

2. Definitions

Unless otherwise specified, the following terms in this agreement have the following meanings:

2.1 This Agreement: Refers to the main text of the "FT Game License and Service Agreement," game rules, supplementary clauses, and revised versions. Once published, the aforementioned content becomes an integral part of this agreement. This agreement also includes the "Necessary Clauses for Network Game Service Format Agreement" formulated by the Ministry of Culture in accordance with the "Interim Measures for the Administration of Online Games" (Ministry of Culture Decree No. 49).

2.2 Game Rules: Refers to the user guidelines, player regulations, game announcements, and notices regarding FT games published and revised by FT from time to time.

2.3 FT Game Software: Refers to the game software provided by FT to you, including but not limited to computer client games, web games, HTML5 games, mobile terminal games, TV terminal games, and other forms of games, as well as related updates, upgrades, patches, expansions, and may include related network servers, websites (including but not limited to official game websites or forums), electronic media, printed materials, or electronic documents.

2.4 FT Game Services: Refers to the various online operation services related to FT game software provided by FT to you, including the FT game software itself.

2.5 Virtual Items: Refers to the game characters, props, equipment, materials, virtual currency, etc., provided by FT to you in the game.

2.6 Game Data: Refers to various data generated by you during the use of FT game software or receipt of FT game services, which are recorded by the server, including but not limited to account data information, character data information, level and virtual item data information (excluding personal identity data such as the user's name, ID number, phone number, etc.).

2.7 Punitive Measures: Refers to the measures that FT may take if you violate this agreement, game rules, relevant laws and regulations, or engage in inappropriate game behavior. These measures include but are not limited to warnings, restrictions or prohibition of the use of all or part of the functions of the game account, deletion of game accounts and game data, deletion of relevant information, game account suspension, game account cancellation, etc.

3 Intellectual Property Rights

3.1 FT legally enjoys all the legitimate rights and interests of FT game software (including but not limited to computer software copyright, artwork copyright, patent rights, and other intellectual property rights involved therein), or has obtained legal authorization from the rightful owners, thereby having the right to provide FT game software and FT game services to users.

3.2 The texts, logos, and other elements (including but not limited to the names, logos, icons of FT game services, the names, logos, icons of FT game software developers) that represent "FT Technology," "Feelingtouch," "FT Games," as well as those used to identify service names and sources in specific services, belong to FT or its affiliated companies, cooperative enterprises, and are trademarks or registered trademarks in China or other countries or regions.

3.3 FT game services may involve third-party intellectual property rights. If such third parties have requirements regarding your use of their intellectual property rights in FT game services, FT will inform you of such requirements in an appropriate manner, and you shall comply with them.

3.4 FT reserves all rights not expressly granted to you in this agreement.

4 Use License

4.1 Under the condition that you accept all the terms of this agreement, FT grants you the right to use FT game software or FT game services. This right is a non-commercial, revocable, changeable, non-exclusive, non-transferable, and non-sub-licensable authorization. Within the authorized scope, you may install FT game software on a single terminal device for personal use and run copies of the FT game software in the manner specified by FT to enjoy the services provided by FT.

4.2 The aforementioned authorization is limited to individual users. If you need to use FT game software or FT game services beyond personal use or for any commercial purposes, you must obtain prior written authorization from FT. Any unauthorized installation, use, access, display, operation, or commercial use constitutes infringement.

4.3 You can obtain FT game software from the FT website or from third parties authorized by FT. If you obtain FT game software or use FT game services from third parties not authorized by FT, it is considered unauthorized, and any losses incurred as a result are your responsibility, for which FT assumes no liability.

4.4 In order to ensure the security and consistency of FT game services, FT has the right to update the FT game software without special notice to you, or to change or restrict certain features or effects. After the release of a new version of the FT game software, FT does not guarantee the continued availability of the old version of the FT game software and the corresponding FT game services. Please check and download the latest version at any time. If you fail to download the latest version of the FT game software in a timely manner, any losses incurred as a result are your responsibility, for which FT assumes no liability.

5 Game Accounts, Virtual Items, and Game Data

5.1 The ownership of game accounts, virtual items, and game data belongs to FT. You have the right to use them and should use them reasonably in accordance with this agreement, game rules, and relevant laws and regulations.

5.2 You should register for an FT member account or other partner accounts recognized by FT using your real identity and use those accounts to access FT game software or receive FT game services. FT will consider the personal information you provide as the sole evidence of the association between the user and the account as well as the user's identity.

5.3 According to the "Provisional Regulations on the Administration of Internet Game Services" and the "Essential Terms of Service Format for Internet Game Services," you should log in to the real-name registration system and complete the real-name registration. When you register, you should provide your own real, legal, accurate, and valid identity information and other relevant information. You must not use someone else's identity information for real-name registration. Otherwise, FT has the right to terminate the provision of FT game services to you and take punitive measures against your game account.

5.4 FT will use your real-name registration information in accordance with relevant national requirements for the anti-addiction system. FT may determine whether you are over 18 years old based on your real-name registration information and decide whether to impose anti-addiction restrictions on your game account.

5.5 FT will actively take reasonable technical and management measures to enhance the security level of the game and protect the security and effectiveness of your game account. However, FT does not guarantee that the aforementioned security measures can completely eliminate the risk of your game account being stolen or lost by others.

5.6 You should properly safeguard your game account and password and use them correctly and securely. FT does not assume any responsibility for any loss suffered by you or others due to the loss or theft of your game account password caused by you.

5.7 If FT restricts, freezes, or terminates your use of the game account in accordance with this agreement, game rules, or relevant laws and regulations, it may result in the deletion of game data and related information under your game account, as well as the loss of related rights. You shall bear the loss on your own, and FT does not assume any responsibility.

5.8 For various virtual items in the game, if there is no special indication regarding the usage period or number of uses, it is assumed that you can continue to use them after obtaining the right to use them until the corresponding FT game service is terminated. If there is a special indication regarding the usage period or number of uses, the usage period indicated by the special indication shall prevail. Once the usage period or number of uses is exceeded, FT has the right to revoke the usage right without providing special notice to you (the usage period is not interrupted or suspended for any reason).

5.9 In order to better provide FT game services to you and other users and maintain fair game order, FT has the right to adjust, update, or optimize the performance and related values of your virtual items. You agree not to hold FT liable for any legal responsibility arising from the aforementioned adjustments, updates, or optimizations.

5.10 FT has the right to establish, add, or modify virtual items obtained through the exchange of Chinese yuan (RMB) as needed in the game. If Chinese yuan is exchanged for the aforementioned virtual items, it is considered as having been used; virtual items cannot be exchanged for Chinese yuan.

5.11 In order to efficiently utilize server resources, if you do not use the game account for 12 consecutive months, FT has the right to take measures such as deletion of the account, virtual items, game data, etc. under that account. The aforementioned measures may result in the loss of your related rights under that game account, and FT does not assume any responsibility for this.

5.12 If you use FT game software or receive FT game services without registering an account through "Quick Game," "Guest Login," or similar modes, please register and bind a game account promptly. If you do not register and bind a game account, you will be unable to use the online game recharge service. If you uninstall or reinstall FT game software or if the software cannot start properly due to terminal equipment damage, you will be unable to query or recover all virtual items and game data in the offline games and online games where you have not registered and bound a game account.

5.13 In the single-player games provided by FT, the recharge system can only be used after accessing the Internet. If you use the recharge system to make a recharge, the recharge information will be confirmed through the Internet. All game data in the single-player games will be saved on your terminal device. If you uninstall or reinstall FT game software or if the software cannot start properly due to terminal equipment damage, all your virtual items.

6. User Game Behavior Code

6.1 You should have the necessary equipment to use FT game software or receive FT game services, including but not limited to mobile devices (phones, tablets, etc.), computers, wireless routers, or other necessary internet devices.

6.2 You are responsible for the telecommunications expenses and other network usage fees related to this service.

6.3 You should comply with this agreement, game rules, and relevant laws and regulations of the People's Republic of China. If you are a user outside the mainland of the People's Republic of China, you should also comply with the laws and regulations of your country or region.

6.4 When using FT game software or receiving FT game services, you should take responsibility for the information content you publish and must not publish the following content:

• 6.4.1 Content that opposes the basic principles established in the Constitution of the People's Republic of China.
• 6.4.2 Content that endangers national security, leaks state secrets, subverts the state power, or undermines national unity.
• 6.4.3 Content that harms the national honor and interests.
• 6.4.4 Content that incites ethnic hatred or discrimination, or disrupts ethnic unity.
• 6.4.5 Content that undermines the state's religious policies or promotes cults and feudal superstitions.
• 6.4.6 Content that spreads rumors, disrupts social order, or undermines social stability.
• 6.4.7 Content that spreads obscenity, pornography, gambling, violence, murder, terrorism, or instigates crimes.
• 6.4.8 Content that insults or defames others, or infringes upon others' legitimate rights and interests.
• 6.4.9 Content that promotes or incites the use of cheats, private servers, or Trojan horses.
• 6.4.10 Content that includes homepage addresses or links of software, files, etc., which are deemed inappropriate or not approved by FT.
• 6.4.11 Other improper behaviors widely recognized in the industry or content prohibited by laws and regulations of the People's Republic of China.

6.5 You must not use improper or unfair methods to use FT game software or receive FT game services, including but not limited to:

• 6.5.1 Attacking or intruding FT's website servers, or logging in or attempting to log in to the servers with a frequency exceeding normal user login requirements within a concentrated period of time, thereby overloading the website servers.
• 6.5.2 Cracking or modifying the FT-provided FT game software programs.
• 6.5.3 Attacking or intruding FT's game servers or game server programs, or causing the game servers to be overloaded.
• 6.5.4 Creating, publishing, spreading, or using any form of auxiliary tools or programs (cheats) that hinder game fairness, operating concurrently with FT game software, simulating user operations, changing the operating environment, modifying data, or affecting game operations.
• 6.5.5 Exploiting program vulnerabilities and errors (bugs) to disrupt the normal progress of the game or spread such vulnerabilities or errors.
• 6.5.6 Unreasonably interfering with or obstructing others from using FT-provided FT game software or FT game services.
• 6.5.7 Using FT game software (private servers) through abnormal or illegal means.
• 6.5.8 Logging into the game using abnormal methods (including but not limited to using third-party software or systems not developed, authorized, or approved by FT), using network accelerators, external cheat software, or robot programs to maliciously disrupt service facilities and disturb the normal service order.
• 6.5.9 Modifying, translating, annotating, organizing, compiling, or deducing FT game software.
• 6.5.10 Exploiting technical defects or vulnerabilities that may exist in FT game software in various forms for personal gain (including but not limited to copying game virtual items) or engaging in other improper behaviors.

6.6 FT will monitor your game data and use it as a basis for determining whether you are engaged in cheating behavior using cheat programs and other methods. FT has the right to take corresponding punitive measures against you based on the seriousness of the circumstances according to this agreement. For serious cases, FT may transfer the matter to relevant administrative authorities for administrative penalties or pursue criminal responsibility.

7. Information Collection and Privacy Protection

7.1 You agree that FT collects your user information for the purpose of fulfilling this agreement or as required by administrative or judicial authorities. The aforementioned information includes the information you registered in the real-name registration system, your game data, and other information that you provide to FT or that FT needs to collect based on security, user experience optimization, and other considerations during your use of FT game software or receipt of FT game services. FT's collection of your user information will comply with relevant laws and regulations.

7.2 You agree that FT, its affiliated companies, and partner companies may use your user information to provide you with various types of information about FT games, including activity information and promotional information, through SMS, phone calls, emails, and other means.

7.3 Except as otherwise provided in this agreement, FT's collection, use, and protection of user information will comply with the Privacy Policy published by FT.

8. Disclaimer

8.1 FT cannot guarantee that the FT game software or FT game services will be error-free, uninterrupted, all defects have been corrected, or that the FT game software or FT game services will not be damaged by viruses or any other factors. Unless otherwise required by law, FT expressly disclaims any express or implied warranties, including but not limited to warranties of performance, applicability, or non-infringement of the FT game software or FT game services.

8.2 In no event shall FT be liable for any losses incurred by you in using the FT game software or receiving FT game services due to force majeure. Such force majeure events include but are not limited to national laws, regulations, policies, orders from national authorities, and other government actions, as well as unpredictable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, wars, and others.

8.3 FT may independently decide to change, terminate, or suspend your use of any FT game services at any time without prior notice, except as otherwise provided in this agreement or required by law and regulations. If your actions violate this agreement, game rules, or relevant laws and regulations, FT may terminate or suspend your use of any FT game services in accordance with the aforementioned provisions, and FT shall not be liable to you and has the right to require you to assume corresponding responsibilities.

8.4 Game software bugs, version update defects, third-party virus attacks, or any other factors may cause abnormalities in your game account, virtual items, game data, etc. Before the cause of the data abnormality is determined, FT has the right to temporarily freeze the corresponding game account. If it is determined that the data abnormality is caused by your or a third party's violation of the user game behavior norms stipulated in this agreement, FT has the right to restore the game account, virtual items, game data, etc. to the original state before the abnormality occurred (including recovering transferred data from third parties), and FT shall not be liable to you.

8.5 FT does not authorize you to obtain game accounts, virtual items, etc., from any third party through purchase, gifting, or any other means. FT is not responsible for third-party transactions and does not handle appeals arising from disputes related to any third-party transactions.

8.6 Due to objective conditions, there may be cases where the same online game is not compatible between different operating systems, and the same standalone game may not be compatible between different terminal devices. This may result in the inability to smoothly transfer your game account, virtual items, and game data from one operating system or terminal device to another. The risk of losing game accounts, virtual items, and game data caused by switching between different operating systems or terminal devices is your own responsibility, and FT shall not be liable to you.

8.7 You should be aware that commercial advertisements or other promotional activities may be published within the FT game. These advertisements or promotional activity information are provided by advertisers or commercial service providers who are responsible for them. FT only serves as a medium for publishing the content. The transaction activities of goods or services purchased through links to such websites or advertisements exist solely between users and the providers of those goods or services, and are unrelated to FT. FT shall not be liable for any legal responsibilities arising from your transaction activities with the providers of those goods or services.

9. Damages and Compensation

9.1 If you violate national laws, regulations, or the provisions of this agreement in the game, causing damages to FT or third parties, you shall bear corresponding legal responsibilities.

9.2 FT has the right to take all reasonable actions to recover the losses from you and request you to bear reasonable recovery costs (including but not limited to litigation expenses, attorney fees, investigation and evidence collection costs, actual losses incurred, etc.) arising from legal proceedings, administrative procedures, and others.

10. Agreement Changes

10.1 FT has the right to modify the terms of this agreement when necessary and provide notice on relevant pages. You can refer to the latest version of the agreement terms on the relevant pages (including but not limited to the official website, game client, etc.).

10.2 After the modification of the agreement terms, if you continue to use FT game software or receive FT game services, it shall be deemed that you have accepted the modified agreement. If you do not accept the modified agreement, you should stop using FT game software or receiving FT game services.

11. Jurisdiction and Applicable Law

11.1 The place of signing this agreement is Yuhang District, Hangzhou City, Zhejiang Province, People's Republic of China.

11.2 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland of the People's Republic of China, excluding the application of any other conflicting laws.

11.3 In the event of any dispute or controversy between you and FT arising from this agreement, the parties agree to first attempt to resolve the dispute through friendly consultation. If the consultation fails, both parties agree to submit the dispute or controversy to the people's court with jurisdiction at the place of signing this agreement.

12. Miscellaneous

12.1 The headings of all clauses in this agreement are for convenience of reading only and have no substantive meaning. They shall not be used as a basis for interpreting the meaning of this agreement.

12.2 If any provision of this agreement is determined to be wholly or partially invalid or unenforceable for any reason, the other provisions of this agreement shall remain valid and enforceable.

12.3 FT's failure or delay in exercising or enforcing any right provided by this agreement or by law shall not be deemed as a waiver of that right and shall not affect FT's exercise of such right in the future.

12.4 In accordance with the advice on healthy gaming from the National Press and Publication Administration, FT reminds you to resist unhealthy games, refuse pirated games; pay attention to self-protection, guard against fraud; moderate gaming is beneficial to the mind, addiction to games is harmful to the body.
